前總統陳水扁，日前被黃姓麵包師傅二度拍攝散步影片，引起扁爆怒指責，扁是否已復原該回監獄服刑，引起爭辯，扁保外醫治第7次展延期限於4日到期，台中監獄醫療小組評估其病況未改善，報請矯正署核准扁第8次展延保外醫治3個月，至2017年2月4日止，代表阿扁今年農曆春節可在家過年。
台中監獄表示，一切依據醫療小組專業評估，不能就外傳影片內容判斷扁的身體狀況。台中監獄綜合每月派員前往扁住處訪視的結果，及高雄長庚紀念醫院診斷證明書、病情評估表等，依據醫療小組專業評估，認為扁的病況未明顯改善，仍符合監獄行刑法第58條「在監不能為適當之醫治」，報法務部矯正署審核。
台中監獄表示，展延期間獄方仍將持續派員查看陳前總統病情變化，做為後續辦理終止或展延保外醫治的準則。
